Part 1 — Terms of sale

1. What you're buying

1.1 Digital products.Our digital products are guides, playbooks, Claude skill packs and automation kits. They're delivered as downloads. Each product page describes what's included.

1.2 Install add-ons. An install add-on is a service. We set up a kit with you on a screen-share call.

1.3 Third-party tools.Some products work with other companies' tools and services, such as Make, Xero, Google, Microsoft, Stripe and Anthropic's Claude. We don't own or control them. Their features, prices, terms and availability can change, and you need your own accounts with them.

2. Prices, GST and payment

2.1 Price basis. Prices are in New Zealand dollars and exclude GST.

2.2 GST. GST at 15% is added at checkout for customers in New Zealand. Overseas business customers are generally not charged NZ GST. Checkout calculates the tax that applies.

2.3 Payment and invoices.Payment is processed by Stripe. We don't see or store your card details. A tax invoice is issued for every purchase.

2.4 Running costs. Third-party running costs, such as Make plans, AI usage, SMS charges or Google Workspace, are yours to pay. Product pages give estimates, but those providers set their own prices.

3. Delivery

3.1 Download links. Download links are shown after payment and emailed to you. Links last 30 days and allow up to 10 downloads each. You can request fresh links at any time from the Resend downloads page.

3.2 Delayed payments. If a payment method takes time to clear, delivery happens once the payment clears.

4. Install add-ons

4.1 Booking. Book your install session using the link we email you. Please book within 60 days of purchase.

4.2 During the session.You log in to your own accounts during the session. We never ask you to send us passwords. You're responsible for having the accounts, plans and admin access the product page lists.

4.3 No suitable time.If we can't find a time that suits us both within 60 days, we'll refund the install add-on.

4.4 Missed sessions.Missed sessions can be rescheduled once without charge if you give at least 24 hours' notice.

5. Support and updates

5.1 Support.Automation kits and the Claude Skills Pack include 14 days of email support from the date of purchase. For guides, reply to your order email if you're stuck.

5.2 Updates.For 12 months after purchase, we'll provide updated files if a change by Make or a connected app stops a kit working as described, where a reasonable fix is available.

6. 30-day money-back guarantee

6.1 When we refund.If you can't get a product working after one support email, or it isn't what its product page describes, email support@fsmdevelopments.co.nz within 30 days of purchase and we'll refund what you paid for that product.

6.2 Install add-ons.An install add-on can be refunded under this guarantee until the session takes place. After a completed session, it's refundable only if we couldn't get the kit working for reasons within our control.

6.3 Refund method. Refunds go back to the original payment method.

6.4 Abuse. We may decline refunds where the guarantee is clearly being abused, for example repeated purchase-and-refund.

7. Using AI and automations responsibly

7.1 Review AI output.AI-generated content can be wrong. You're responsible for reviewing what your automations and AI tools produce before relying on it or sending it, especially anything about money, legal matters or personal information.

7.2 Your legal obligations.You're responsible for using the products lawfully. That includes your obligations under the Privacy Act 2020, the Unsolicited Electronic Messages Act 2007, and the terms of the third-party services you connect.

7.3 General information only.Our guides and playbooks are general information. They're not legal, tax, employment or financial advice.

8. Business purchasers

8.1 Contracting out. If you buy for the purposes of a business, you agree that, to the extent the law allows:

  • the Consumer Guarantees Act 1993 does not apply; and
  • sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply;

and that this is fair and reasonable.

8.2 Consumer purchasers.If you're a consumer, nothing in these terms limits your rights under New Zealand consumer law.

9. Liability

9.1 Cap. To the extent the law allows, our total liability for any claim about a product or service is limited to the amount you paid for it.

9.2 Excluded losses.We're not liable for:

  • indirect or consequential loss, or loss of profit, revenue or data;
  • outages or changes in third-party services; or
  • the content of messages your automations send.

10. General

10.1 Changes. We may update these terms. The terms in force when you buy apply to that purchase.

10.2 Governing law. These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.

Part 2 — Licence

Licence

When you buy a digital product, we give you a non-exclusive, non-transferable licence to use it within one business. That covers you and the business's own staff and contractors, for the business's own purposes.

You may:

  • use, adapt and edit the guides, prompts, templates, skills and blueprints for your business;
  • install a kit on the accounts your business uses; and
  • keep using the version you bought after any updates period ends.

You may not:

  • share, publish or resell the products, or any substantial part of them, outside your business;
  • repackage them as your own product or service; or
  • use them to deliver services to other businesses without a separate agreement with us.

We keep all intellectual property in the products. Your business owns the content its automations produce.
